Alan H. Scheiner Counsel

Alan Scheiner represents LLF clients in financial and business litigation, including matters involving investment and commercial banking, derivatives, business torts, lender liability and financial fraud, as well as general commercial litigation. In the course of 20 years litigating civil and criminal cases, Mr. Scheiner has also represented clients in white-collar criminal matters, regulatory investigations, constitutional litigation under Section 1983, state Attorney General civil-enforcement matters, and products liability, securities fraud and accounting litigation.

Mr. Scheiner's practice centers on commercial and investment banking disputes, including matters involving securities financing and credit derivatives. Representative matters include:

  • Defense of major money center commercial bank in a claim alleging liability for negligence and aiding and abetting in connection with a Ponzi scheme operated using accounts at the bank.

  • Defense of a business valuation consultant in a claim for alleged negligent valuation of equity shares in a closely held company. 

  • Representation of a major money center investment bank in an arbitration and mediation concerning disputes over hedge fund placement fees.

  • Representation of a major money center investment bank in litigation seeking to enforce an interest rate swap.

  • Representation of a major money center investment bank in a litigation concerning disputes over private equity management and marketing fees.

  • Defense of a major money center investment bank in a multi-state litigation brought by hedge funds and their investment manager, challenging margin calls issued under swaps and securities lending contracts during the financial crisis; resulting in two court rulings dismissing the complaints.

  • Defense of a major money center commercial bank in a claim for aiding and abetting an international investment manager fraud, resulting in a dismissal of the complaint, affirmed in the Second Circuit.

  • Successful representation of venture capital investors in a closely-held company, in a dispute between the company founder and the investors concerning trade secrets, fiduciary duties and LLC operational issues.

  • Successful defense of a major money center commercial bank in a multi-million dollar fraud claim in New York State court, resulting in summary judgment for the defendant, affirmed on appeal.

  • Defense of a lender liability claim against a major money center commercial bank, brought for termination of a line of credit, resulting in a favorable settlement. 

Before joining LLF as Counsel in August 2007, Mr. Scheiner served for six years in the Corporation Counsel's Office of the City of New York as an Assistant Corporation Counsel and Senior Counsel in the Special Federal Litigation Division. In that role, Mr. Scheiner successfully defended several federal court jury trials and represented the City of New York and New York City Police Department officials and police officers in high-profile, complex civil rights litigation. Mr. Scheiner's prior law firm experience includes serving in the litigation groups of both Debevoise & Plimpton LLP, in New York, and Zuckerman Spaeder LLP in Washington, D.C. and New York.

Education

Mr. Scheiner is a graduate of Columbia Law School, 1991, where he was an editor of the Columbia Law Review and was a Harlan Fiske Stone Scholar for three years. He received a B.A. with Honors in Economics from the University of Pennsylvania in 1986, and attended the London School of Economics for his junior year of college.
