Mortgage-Backed Securities Litigation

LLFW has defended a major money center investment bank in federal court litigation alleging fraud in connection with the sale of mortgage backed securities, winning a motion to dismiss the complaint, and thereby obviating the need for costly and time-consuming discovery.  Among other issues in the case, LLFW established before the District Court that the offering documents for the securities provided sufficient information to prospective buyers to preclude the claim of fraud.  LLFW prevailed on appeal of that dismissal to the Sixth Circuit.  LLFW has developed substantial knowledge of the evolving law in this active field of litigation, and the factual issues concerning loan origination and securities marketing that are common to MBS fraud claims arising from the financial crisis.
